ARTICLE 2: FORMATION OF THE CONTRACT AND ORDERS
2.1 Tariffs
The sale prices of the products are indicated in Euros or in USD according to the means of sale (instagram, facebook...) and are those in force at the time of the recording of the order by the Purchaser.
They do not include shipping costs, charged in addition to the price of products purchased depending on the geographical area of the Buyer. The shipping costs are indicated before the registration of the order by the Buyer. The amount invoiced takes into account any commisions and fees applied by Paypal. It may therefore differ from the amount announced.
2.2 Product characteristics
In accordance with Article L.111-1 of the Consumer Code, the Buyer may, prior to placing an order, take note, on the sales medium (instgram or facebook), of the essential characteristics of the product(s) he wishes to order.
The photographs, graphics and descriptions of the products offered for sale are only indicative and do not bind the seller.
2.3 Ordering
Any order supposes the adhesion without restriction nor reserve to the present conditions of sale. Any dispute relating to the sale will be subject to French law before the court of Le PUY EN VELAY (63) in France. The Buyer declares to have taken knowledge and accepted the present general conditions of sale at the time of the validation of his order.
Knives, daggers etc... are forbidden for sale to minors.
The sale will only be considered final after OPUS Knives & Design has sent the Buyer confirmation of the order by e-mail and has received payment in full. In the absence of proof to the contrary, the data recorded by OPUS Knives & Design constitutes proof of all transactions between OPUS Knives & Design and its customers. OPUS Knives & Design recommends that the Buyer keep this information on a paper or computer document.
ARTICLE 3: PAYMENT
Payment must be made at the time of the order by the Buyer. At no time, the sums paid can be considered as a deposit or advance payment.
All orders are payable in euros or dollars. To pay his order, the Buyer has the following payment methods: Credit card, bank payment in 3 X and bank transfer.
OPUS Knives & Design reserves the right to suspend or cancel any order and/or delivery, whatever its nature and level of execution, in the event of non-payment of any sum due by the Buyer or in the event of a payment incident.
In the context of the fight against Internet fraud, the information relating to your order may be transmitted to any third party for verification.
ARTICLE 4: SHIPPING
The products are delivered to the delivery address indicated by the Buyer during the ordering process.
Our goods travel at the risk of the recipient. The delivery times are those given by LA POSTE. Possible delays do not give the buyer the right to cancel the sale, to refuse the goods or to claim damages.
4.1 Deadlines France
Colissimo: For France, packages are sent by registered colissimo. The delay is 2 working days. The registered colissimo is delivered against signature.
Smaller products are sent by recorded delivery. A followed letter announced BOOK by the number of follow-up could not in no case to make a refunding or replacement of the products.
4.2 Export deadlines
For foreign countries, parcels are sent by registered priority mail. Delivery times are from 4 to 20 working days depending on the country of destination. These times are given as an indication.
4.3 Transport claims
In the event of a delay in delivery in relation to the date initially set or in the event that the goods are damaged during transport, the Buyer must notify OPUS Knives & Design in writing (letter, fax, email) to enable OPUS Knives & Design to investigate with the carrier.
An investigation with the carrier may take up to 21 working days.
If during this time the product is found, it will be immediately redirected to the place of delivery designated in the order form.
However, if the product ordered is not found after 21 days of investigation, OPUS Knives & Design will proceed at its expense to a refund of the products ordered by the Buyer.
Reservations concerning the control of the goods must be indicated in writing on the delivery note and any complaint must be sent by registered letter to the carrier within 48 hours of delivery.
ARTICLE 5: CLAIMS
To be accepted, any claim for non-conformity or shortage of the goods must be sent within eight days of receipt of the goods by registered letter addressed to OPUS Knives & Design.
ARTICLE 6: LIABILITY
OPUS Knives & Design is released from its obligation to deliver in the event of fortuitous events or force majeure. As an indication, total or partial strikes, especially of postal services and means of transport and/or communication, floods, fires are cases of force majeure.
OPUS Knives & Design cannot be held responsible for any indirect damage that may occur as a result of the purchase of the products. OPUS Knives & Design shall not be liable for any loss of data or files. It is the responsibility of the Buyer to make all necessary backups.
ARTICLE 7: RIGHT OF WITHDRAWAL
In accordance with article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the date of receipt.
In the event of exercising the right of withdrawal, OPUS Knives & Design will reimburse the Buyer the sums paid (excluding the shipping costs) as long as the product delivered is returned to OPUS Knives & Design in perfect condition for resale, without having been used and in its original state (packaging, accessories, instructions, etc.), postage paid.
Any risk related to the return of the product is at the charge of the Buyer.
THIS DOES NOT APPLY TO CUSTOM KNIVES WHICH ARE NEVER EXCHANGED OR TAKEN BACK.
ARTICLE 8: RETENTION OF TITLE
OPUS Knives & Design retains full ownership of the products sold until full payment has been received, including all taxes and charges.
ARTICLE 9: TRANSFER OF RISKS
The risks are automatically transferred to the buyer as soon as he takes possession of the goods.
ARTICLE 10: EXPORT
In the case of an export sale, OPUS Knives & Design is not responsible for any non-compliance with local legislation and customs regulations. Customs taxes and other taxes specific to certain countries remain the responsibility of the buyer.
ARTICLE 11: RIGHT TO FREEDOM
In accordance with the French Data Protection Act, the Buyer has the right to access, rectify and request the deletion of data concerning him. OPUS Knives & Design undertakes, therefore, to effectively provide this service as soon as possible.
Furthermore, in application of article 27 of the French Data Protection Act of 6 January 1978, the information required to process requests will not be communicated to third parties without the prior agreement of the Buyer.
